JDSU files patent infringement claim

NOVEMBER 13, 2008 -- On November 7, 2008, JDSU filed a complaint with the U.S. International Trade Commission (ITC) that seeks to halt the import of certain tunable laser chips from its competitors. Citing patent infringements, JDSU filed the complaint against three primary defendants--Bookham, Syntune, and Cyoptics--which manufacture and sell the accused tunable chips at issue in the ITC 39-page complaint.

NOVEMBER 13, 2008 -- On November 7, 2008, JDSU (search for JDSU) filed a complaint with the U.S. International Trade Commission (ITC) that seeks to halt the import of certain tunable laser chips from its competitors. Citing patent infringements, JDSU filed the complaint against three primary defendants--Bookham, Syntune, and Cyoptics--which manufacture and sell the accused tunable chips at issue in the ITC 39-page complaint.

According to the complaint, the patents at issue include U.S. patent no. 6,658, 035, "Tunable Laser Source with Integrated Optical Amplifier," and patent no.6,687,278, "Method of Generating an Optical Signal with a Tunable Laser Source with Integrated Optical Amplifier."

JDSU customers Tellabs, Ciena, Nortel, and ADVA Optical Networking were also named in the ITC complaint insofar as their alleged use and importation of the accused Bookham tunable chips, confirms a JDSU spokesperson in response to an email query from Lightwave.

Bookham, Syntune and Cyoptics are currently involved in separate litigations with JDSU in federal court, in which JDSU has alleged that Bookham, Syntune and Cyoptics infringe two of the same patents at issue in the ITC complaint.
